Terms of Service

1. Who We Are

TigerAds ("TigerAds", "we", "us", or "our") operates a macOS menu-bar advertising platform at trytigerads.com (collectively, the "Service"). The Service connects advertisers who display ads in Mac menu bars with Mac users ("Installers") who earn a share of ad revenue in exchange for hosting those ads.

2. Acceptance of Terms

By downloading, installing, or using the TigerAds application or website in any way, you agree to be legally bound by these Terms. If you do not agree, do not install or use the Service.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction. You must own or have authorised use of the Mac device on which the Application is installed. By using the Service you represent that these conditions are met.

4. Installer Terms

4.1 Earning Credits

Installers earn credits ("Balance") when qualifying ad impressions and clicks are recorded on their device. All eligibility is determined solely by TigerAds' server-side systems. Balances shown in the app are estimates and subject to final audit before any payout is processed.

4.2 Payouts

Payouts are made to the payment account you provide. You are solely responsible for providing accurate and active payment details. TigerAds is not liable for funds sent to incorrect accounts you have provided. Minimum payout amounts and processing timelines may be set or adjusted at our discretion.

4.3 Fraud & Integrity Audits

All payout requests are subject to fraud and integrity review. TigerAds reserves the right, in its sole and absolute discretion, to delay, reduce, withhold, or permanently forfeit any Balance, and to suspend or terminate any account, if we determine or reasonably suspect that you have engaged in any of the following prohibited activities:

• Using scripts, macros, automation tools, or any non-human method to simulate activity or screen states.
• Bypassing the official Application to send requests directly to TigerAds servers to log impressions or clicks.
• Running the Application inside a virtual machine, emulator, container, or any non-standard desktop environment.
• Using a VPN, proxy, or any tool to misrepresent your geographic location.
• Exhibiting patterns inconsistent with genuine human Mac use.
• Installing the Application on a device you do not own or are not authorised to use.
• Creating multiple accounts or coordinating with others to artificially inflate earnings.
• Any other activity that undermines the integrity of the platform.

All payout determinations are final and at TigerAds' sole discretion. TigerAds has no liability for any withheld, reduced, or forfeited Balance.

4.4 Taxes

You are solely responsible for reporting and paying any taxes owed on earnings received through the Service in your jurisdiction. TigerAds does not provide tax advice and makes no representations regarding your tax obligations.

5. Advertiser Terms

5.1 Ad Submission & Approval

All ads are subject to review and approval by TigerAds before going live. We reserve the right to reject or remove any ad at any time, for any reason, without explanation. Prior approval does not waive our right to remove an ad later.

5.2 Prohibited Content

You may not submit ads that contain or promote: illegal products or services; adult or sexually explicit content; hate speech or harassment; malware, phishing, or deceptive material; content that infringes any third-party intellectual property rights; or anything that violates applicable law. Violations may result in immediate account termination and forfeiture of remaining budget without refund.

5.3 Billing & Refunds

Ad budgets are prepaid. Budget consumed by valid impressions is non-refundable. Unused budget may be refunded at our discretion if you pause or remove an ad. If an ad is removed by TigerAds for policy violations, no refund is owed. Any chargeback or payment dispute filed for consumed budget will result in permanent account termination.

5.4 No Impression Guarantee

TigerAds makes no guarantee of minimum impression volumes, click rates, or campaign outcomes. Our server-side records are the sole authoritative source for impression counting and billing.

5.5 Your Responsibilities

By submitting an ad you confirm you hold all rights, licences, and permissions for its content — including trademarks, images, and destination URLs — and that the destination is safe and lawful. You agree to indemnify TigerAds against any claims arising from your ad content.

6. Acceptable Use

You agree not to: reverse-engineer, decompile, or disassemble any part of the Service; interfere with or disrupt our servers or networks; use the Service in violation of any applicable law; impersonate any person or entity; or attempt to gain unauthorised access to any part of the Service or its infrastructure.

7. Intellectual Property

All rights in the Service — including the Application, website, branding, and content created by TigerAds — are our exclusive property. These Terms grant you only a limited, non-transferable licence to use the Service for its intended purpose. No other rights are granted.

8. Termination

We may suspend or terminate your access at any time, for any reason, with or without notice. If termination is due to a breach of these Terms, any accrued Balance may be forfeited. You may stop using the Service and uninstall the Application at any time.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. TigerAds does not warrant that the Service will be uninterrupted or error-free. Your use of the Service is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by law, TigerAds and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of earnings, data, or business — arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed the greater of the amount you paid us in the 3 months preceding the claim or USD $50.

11. Indemnification

You agree to indemnify and hold harmless TigerAds and its operators from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or any content you submit.

12. Governing Law & Disputes

These Terms are governed by the laws applicable in the jurisdiction where TigerAds operates, without regard to conflict of law principles. Any dispute shall be resolved by binding arbitration on an individual basis. You waive any right to participate in a class-action lawsuit or class-wide arbitration against TigerAds.

13. Changes to These Terms

We reserve the right to modify these Terms at any time, at our sole discretion, without prior notice. Changes take effect immediately upon posting. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Service after any change constitutes acceptance of the new Terms. If you do not agree with a change, you must stop using the Service immediately.
